Minutes after deputies saved the man from a potentially fatal collision with a train early one morning last week in Marion County near Ocala, he was arrested and charged with DUI. Apparently the man was so intoxicated he didn’t know about the near death experience he faced.

The event took place at around 1:00am. Two Marion County Sheriffs Office deputies were checking a construction site near a railroad crossing at U.S. Highway 326 and N.E. 36th Avenue when they observed a Nissan car reverse down a dirt road, roll down a four foot high dirt embankment and become stuck on the train tracks.
When the deputies heard a train approaching from the South, they quickly ran to the car and asked the occupants to get out and off of the tracks to safety. Inside were 34 year old driver Simon Kubitza and 39 year old Paula Poissant.
The deputies say they had to ask several times as the couple seemed very unaware of their surroundings or that they were even in danger. After the couple eventually got out of the car, one of the officers got in the driver’s seat while the other lifted and pushed the car free from the tracks.
The officers moved the car to safety just as the train passed by. Kubitza, the driver, was arrested after he failed a field sobriety test. He was transported to the Marion County Jail where he was booked with driving under the influence.
